Supreme Court Expresses Concern Over Non-Implementation of PoSH Act, Calls for Officers in Every District


The Supreme Court has raised concerns about the lack of implementation of the PoSH (Prevention of Sexual Harassment at Workplace) Act, even a decade after its enactment. It highlighted the absence of local complaints committees in several districts and directed strict adherence to the 2013 legislation.


Key Points from the Court's Observations:
1.    Helpline for Women: Women can now register complaints via helpline number 15100.
2.    Deadlines Set: The court set a deadline of January 31, 2025, for appointing District Officers (DOs) responsible for PoSH enforcement in all districts.
3.    Annual Reports: DOs must submit annual compliance reports to ensure the law's effectiveness.
4.    Complaint Committees Mandatory: Every workplace must establish Internal Complaints Committees (ICCs) to address harassment complaints.
5.    Public Awareness Campaigns: Directed state governments to create awareness campaigns to inform women of their rights.
The court emphasised that failure to implement the PoSH Act endangers women in workplaces and reflects systemic inefficiency. Justice Nagarathna underscored the urgency of addressing these issues to ensure a safe working environment.
