SC Asks EC to Examine Applicability of PoSH Act to Political Parties


The Supreme Court of India has directed the Election Commission (EC) to investigate whether registered political parties can be brought under the PoSH Act (Prevention of Sexual Harassment at Workplace Act, 2013). This comes amidst increasing allegations of harassment of women workers and members within political organisations.


During a hearing, advocate Shobha Gupta, representing the petitioner, emphasised that only a few parties, such as the CPM, have established internal complaint committees (ICCs) to address harassment cases. The court acknowledged the seriousness of the issue, stating that political parties, which function as employers, might need to adhere to the law protecting women’s dignity.
The petition cited reports of harassment faced by women within political circles and the lack of mechanisms to address such complaints. A 2014 NDTV survey revealed alarming rates of harassment, with nearly 50% of respondents from political families experiencing verbal or physical abuse.


The SC bench highlighted the importance of equal treatment under the law, urging accountability and institutional mechanisms for safeguarding women in political spaces. The court will await the EC's response to this critical issue.
